Terms & Conditions of business
These Terms & Conditions set out the basis on which YorClear (“we”, “us”, “our”) provides property clearance and related services. By instructing us, you agree to these Terms.
- We provide house clearance, partial clearance, and related services as agreed with you in writing.
- Items may be disposed of, donated, recycled, or offered for sale at our discretion, unless otherwise agreed in advance.
- You must have the legal right to authorise the clearance of the property and disposal of its contents.
- You must provide safe and reasonable access to the property on the agreed date(s).
- You must notify us in advance of any items that require special handling, such as hazardous materials, confidential papers, or items of significant value.
- By engaging YorClear, you confirm that all items for removal are your property or that you have authority to dispose of them.
- Unless otherwise agreed in writing, items removed during clearance remain your property. YorClear will act as your agent in arranging disposal, recycling, donation, or sale of those items.
- Where items are identified as having potential resale value, we may offer to place them into auction through Elstob Auctioneers, or another suitable auction house, subject to separate terms of consignment.
- Any proceeds of sale will be accounted to you in accordance with those auction terms.
- Fees will be confirmed in writing prior to commencement of work.
- Payment is due immediately upon completion of the clearance unless otherwise agreed.
- Additional charges may apply where undisclosed hazardous items, excessive waste, or access difficulties are encountered.
- YorClear will exercise reasonable care and skill in providing its services.
- We cannot accept liability for:
- Pre-existing damage to property or items,
- Loss of items not identified to us in writing as requiring preservation,
- Delays or failures caused by circumstances beyond our reasonable control.
- Our liability to you is limited to the total fee paid for the services provided.
- If you need to cancel or postpone, please give at least 48 hours’ notice.
- Cancellations with less than 48 hours’ notice may incur a charge.
These Terms are governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
